But now, one massive lawsuit just dealt a crippling blow to Biden’s top agenda item.
A critical piece of Joe Biden’s Left-wing agenda was just thrown out of court after a lawsuit found that Biden’s student loan bailout program was unconstitutional.
And now, Biden’s greatest liberal policy victory to date is now in serious danger of being tossed into the trash after a Federal court found that his plan to force the American taxpayers to pay off the debt of other people’s student loans was unconstitutional.
This lawsuit could end up being the largest political defeat for Joe Biden yet, and there are signs that the case could end up in the Supreme Court before 2024.
Politico reports, “A federal judge in Texas has struck down President Joe Biden’s student debt relief program, dealing the most serious blow yet to the administration’s efforts to cancel student loans for millions of Americans.”
“U.S. District Judge Mark Pittman, a Trump appointee, ruled on Thursday that Biden’s debt relief program is “an unconstitutional exercise of Congress’s legislative power and must be vacated.”
The lawsuit comes at a time when Joe Biden is staring down the possibility of a Republican-controlled House of Representatives in the wake of the 2022 midterm elections.
And without the support of Democrats in both chambers of Congress, it appears nearly impossible for Biden to ram his student loan bailout through the legislative process and actually get a bill on his desk to sign.
This means that unless the lawsuit is overturned in an appeal’s court, Biden’s student loan bailout plan could end up being scrapped for good.
“The Education Department had already been prohibited from moving ahead with Biden’s student debt relief program under a temporary order from a federal appeals court in a separate case.
But the latest decision goes much further in permanently prohibiting the Education Department from carrying out the entire program,” adds Politico.
And for hundreds of millions of American taxpayers who are currently being crushed by crippling inflation, this victory presents an important milestone in support of the idea that Democrats should not be able to impose debt relief programs on the rest of the country simply to placate their liberal base, which stands to reap the greatest amount of benefits from any student loan bailout.
The failure of Biden’s proposal in the courts also will help mitigate the effects of inflation, as there will be less money printed off in order to pay off the debt of those who willingly took the loans out.
“Whether the Program constitutes good public policy is not the role of this Court to determine,” wrote Judge Pittman in a scathing takedown of Biden’s policy. “Still, no one can plausibly deny that it is either one of the largest delegations of legislative power to the executive branch, or one of the largest exercises of legislative power without congressional authority in the history of the United States.”
